Purpose and who we are<\/h2>\r\n\r\n<p>\r\n<strong>Tender Hand Healthcare Services LLC<\/strong>\r\nmay be referred to in this Notice as\r\n\u201cTender Hand,\u201d \u201cTHHS,\u201d \u201cwe,\u201d \u201cus,\u201d or \u201cour.\u201d\r\n<\/p>\r\n\r\n<p>\r\nTHHS provides person-centered healthcare, community-based support,\r\nrespite, and related services to individuals and families throughout New Jersey.\r\n<\/p>\r\n\r\n<p>\r\nDuring the course of providing and coordinating services,\r\nTHHS may create, receive, maintain, or share information about:\r\n<\/p>\r\n\r\n<ul>\r\n<li>Your health, support needs, abilities, preferences, and personal goals.<\/li>\r\n<li>Services you receive from THHS or another provider.<\/li>\r\n<li>Your Individualized Service Plan, assessments, progress notes, and care documentation.<\/li>\r\n<li>Your medications, medical history, allergies, diagnoses, and safety needs.<\/li>\r\n<li>Payment, eligibility, service authorization, and billing information.<\/li>\r\n<li>Incidents, complaints, investigations, or quality reviews involving your services.<\/li>\r\n<\/ul>\r\n\r\n<p>\r\nThis Notice describes the privacy practices followed by THHS, its workforce,\r\nand other persons who are legally authorized to act on its behalf.\r\n<\/p>\r\n\r\n<div class=\"dignity-note\">\r\n<p>\r\n\u201cProtecting your information means respecting the person,\r\nthe choices, and the life behind every record.\u201d\r\n<\/p>\r\n<\/div>\r\n\r\n\r\n<!-- =========================================\r\n     SECTION 2\r\n========================================== -->\r\n\r\n<h2 id=\"npp-phi\">2. What protected health information means<\/h2>\r\n\r\n<p>\r\n<strong>Protected health information, or PHI,<\/strong>\r\nis information that identifies you, or could reasonably be used to\r\nidentify you, and relates to:\r\n<\/p>\r\n\r\n<ul>\r\n<li>Your past, present, or future physical or mental health condition.<\/li>\r\n<li>Healthcare, support, or other covered services provided to you.<\/li>\r\n<li>Payment for healthcare or covered services.<\/li>\r\n<\/ul>\r\n\r\n<p>PHI may exist in many forms, including:<\/p>\r\n\r\n<ul>\r\n<li>Paper files and handwritten records.<\/li>\r\n<li>Electronic records, emails, secure portals, and digital documentation.<\/li>\r\n<li>Photographs, video, or audio connected to your care.<\/li>\r\n<li>Telephone, virtual, or in-person conversations.<\/li>\r\n<li>Billing, authorization, and Medicaid records.<\/li>\r\n<\/ul>\r\n\r\n<p>\r\nInformation may still be protected even when it does not include your\r\nfull name. Other details, when combined, may identify you.\r\n<\/p>\r\n\r\n<div class=\"important\">\r\n<p class=\"important-title\">Need-to-know access<\/p>\r\n<p>\r\nTHHS limits access to your information to workforce members and authorized\r\npersons who need it to provide, coordinate, administer, monitor,\r\nor support your services, or to perform another function\r\npermitted or required by law.\r\n<\/p>\r\n<\/div>\r\n\r\n\r\n<!-- =========================================\r\n     SECTION 3\r\n========================================== -->\r\n\r\n<h2 id=\"npp-responsibilities\">3. Our responsibilities to you<\/h2>\r\n\r\n<p>\r\nTHHS is required to protect the privacy and security of your PHI\r\nand to follow the terms of the Notice of Privacy Practices currently in effect.\r\n<\/p>\r\n\r\n<div class=\"promise-grid\">\r\n\r\n<article class=\"promise-card\">\r\n<p class=\"promise-number\">01<\/p>\r\n<h3>Protect your privacy<\/h3>\r\n<p>\r\nWe use reasonable administrative, physical, and technical safeguards to help\r\nprevent unauthorized access, use, loss, or disclosure of your PHI.\r\n<\/p>\r\n<\/article>\r\n\r\n<article class=\"promise-card\">\r\n<p class=\"promise-number\">02<\/p>\r\n<h3>Limit information appropriately<\/h3>\r\n<p>\r\nWhen the minimum-necessary standard applies, we make reasonable efforts to use,\r\nrequest, or disclose only the amount of information needed for the purpose.\r\n<\/p>\r\n<\/article>\r\n\r\n<article class=\"promise-card\">\r\n<p class=\"promise-number\">03<\/p>\r\n<h3>Provide this Notice<\/h3>\r\n<p>\r\nWe provide this Notice to individuals receiving services and,\r\nwhen applicable, their legal guardians or personal representatives.\r\n<\/p>\r\n<\/article>\r\n\r\n<article class=\"promise-card\">\r\n<p class=\"promise-number\">04<\/p>\r\n<h3>Respect your rights<\/h3>\r\n<p>\r\nWe provide reasonable ways for you to access your records,\r\nrequest corrections, ask for restrictions,\r\nand exercise your other privacy rights.\r\n<\/p>\r\n<\/article>\r\n\r\n<article class=\"promise-card\">\r\n<p class=\"promise-number\">05<\/p>\r\n<h3>Tell you about certain breaches<\/h3>\r\n<p>\r\nWe will notify you when required if a breach compromises the privacy\r\nor security of your unsecured PHI.\r\n<\/p>\r\n<\/article>\r\n\r\n<article class=\"promise-card\">\r\n<p class=\"promise-number\">06<\/p>\r\n<h3>Never retaliate<\/h3>\r\n<p>\r\nTHHS will not deny services, retaliate, or treat you unfairly because you\r\nexercise a privacy right or submit a complaint in good faith.\r\n<\/p>\r\n<\/article>\r\n\r\n<\/div>\r\n\r\n<p>\r\nWe train members of our workforce regarding their privacy and\r\nconfidentiality responsibilities. We also require appropriate privacy\r\nprotections from outside organizations that perform certain services for THHS\r\nand have access to PHI.\r\n<\/p>\r\n\r\n\r\n<!-- =========================================\r\n     SECTION 4\r\n========================================== -->\r\n\r\n<h2 id=\"npp-treatment-payment-operations\">4. Treatment, payment, and healthcare operations<\/h2>\r\n\r\n<p>\r\nHIPAA generally permits THHS to use and disclose your PHI for treatment,\r\npayment, and healthcare operations without obtaining a separate written\r\nauthorization from you.\r\n<\/p>\r\n\r\n<p>\r\nThese uses and disclosures allow THHS and other authorized providers\r\nto coordinate services, maintain safe and effective support,\r\nand carry out essential operations.\r\n<\/p>\r\n\r\n<h3>Treatment and coordination of services<\/h3>\r\n\r\n<p>\r\nWe may use or share your PHI to provide, coordinate, manage,\r\nor support your healthcare and community-based services.\r\n<\/p>\r\n\r\n<p>This may include communicating with:<\/p>\r\n\r\n<ul>\r\n<li>Your physicians, nurses, pharmacists, therapists, or other healthcare professionals.<\/li>\r\n<li>Your Support Coordinator or care-management team.<\/li>\r\n<li>Your legal guardian, personal representative, or another person legally authorized to participate in decisions.<\/li>\r\n<li>Hospitals, emergency responders, laboratories, pharmacies, or other service providers.<\/li>\r\n<li>Direct Support Professionals and other THHS workforce members assigned to support you.<\/li>\r\n<\/ul>\r\n\r\n<div class=\"example\">\r\n<p class=\"example-label\">Example<\/p>\r\n<p>\r\nA THHS staff member may share information about your allergies,\r\nmedications, mobility needs, communication preferences,\r\nor safety plan with an authorized healthcare provider or support\r\nprofessional who needs that information to assist you safely.\r\n<\/p>\r\n<\/div>\r\n\r\n<h3>Payment and service authorization<\/h3>\r\n\r\n<p>\r\nWe may use or disclose your PHI to obtain payment, confirm eligibility,\r\nsecure service authorization, submit claims,\r\nor respond to billing and payment questions.\r\n<\/p>\r\n\r\n<p>This may include communication with:<\/p>\r\n\r\n<ul>\r\n<li>New Jersey Medicaid.<\/li>\r\n<li>The New Jersey Division of Developmental Disabilities.<\/li>\r\n<li>Fiscal intermediaries, managed-care organizations, or other authorized payers.<\/li>\r\n<li>Government agencies responsible for approving, funding, reviewing, or auditing services.<\/li>\r\n<\/ul>\r\n\r\n<div class=\"example\">\r\n<p class=\"example-label\">Example<\/p>\r\n<p>\r\nTHHS may submit information showing the authorized service,\r\ndate of service, amount of service delivered,\r\nand supporting documentation needed for Medicaid or another authorized\r\npayer to process a claim.\r\n<\/p>\r\n<\/div>\r\n\r\n<h3>Healthcare operations<\/h3>\r\n\r\n<p>\r\nWe may use or disclose your PHI for activities necessary to operate\r\nTHHS and maintain the quality, safety, integrity,\r\nand effectiveness of our services.\r\n<\/p>\r\n\r\n<p>Healthcare operations may include:<\/p>\r\n\r\n<ul>\r\n<li>Quality assessment and quality-improvement activities.<\/li>\r\n<li>Reviewing whether services are appropriate, effective, and consistent with your plan.<\/li>\r\n<li>Staff supervision, training, competency review, and performance evaluation.<\/li>\r\n<li>Credentialing, licensing, compliance, and accreditation activities.<\/li>\r\n<li>Incident management, risk management, and safety review.<\/li>\r\n<li>Complaint, grievance, and appeal review.<\/li>\r\n<li>Financial, billing, legal, and compliance activities.<\/li>\r\n<li>Audits, inspections, program monitoring, and authorized oversight.<\/li>\r\n<li>Business planning, administration, and service improvement.<\/li>\r\n<\/ul>\r\n\r\n<div class=\"example\">\r\n<p class=\"example-label\">Example<\/p>\r\n<p>\r\nTHHS may review service notes, incident documentation,\r\nor feedback from you and your support team to determine whether services\r\nare meeting your needs and whether improvements are necessary.\r\n<\/p>\r\n<\/div>\r\n\r\n<div class=\"important\">\r\n<p class=\"important-title\">The minimum-necessary standard<\/p>\r\n<p>\r\nWhen the minimum-necessary requirement applies,\r\nTHHS makes reasonable efforts to limit a use, request,\r\nor disclosure to the information reasonably needed for its purpose.\r\n<\/p>\r\n<p>\r\nThe minimum-necessary requirement does not apply in every circumstance,\r\nincluding certain disclosures for treatment,\r\ndisclosures made directly to you,\r\nuses or disclosures made under your authorization,\r\nand disclosures required by law.\r\n<\/p>\r\n<\/div>\r\n\r\n\r\n<!-- =========================================\r\n     SECTION 5\r\n========================================== -->\r\n\r\n<h2 id=\"npp-other-uses\">5. Other uses and disclosures permitted or required by law<\/h2>\r\n\r\n<p>\r\nTHHS may use or disclose your PHI without your written authorization in other\r\ncircumstances permitted or required by law. We will limit the information shared\r\nwhen the minimum-necessary standard applies.\r\n<\/p>\r\n\r\n<h3>Public health and safety activities<\/h3>\r\n\r\n<p>\r\nWe may disclose information to authorized public health agencies or other\r\nresponsible authorities for activities such as:\r\n<\/p>\r\n\r\n<ul>\r\n<li>Preventing or controlling disease, injury, or disability.<\/li>\r\n<li>Reporting communicable diseases or other conditions required by law.<\/li>\r\n<li>Reporting certain adverse events, product problems, or safety concerns.<\/li>\r\n<li>Helping prevent or reduce a serious and imminent threat to health or safety.<\/li>\r\n<\/ul>\r\n\r\n<h3>Reporting abuse, neglect, or exploitation<\/h3>\r\n\r\n<p>\r\nWe may disclose information to an authorized government or protective-services\r\nagency when we reasonably believe that a person may be a victim of abuse,\r\nneglect, exploitation, or domestic violence, or when reporting is otherwise\r\nrequired by law.\r\n<\/p>\r\n\r\n<h3>Health oversight<\/h3>\r\n\r\n<p>\r\nWe may disclose PHI to government agencies legally authorized to conduct audits,\r\ninspections, investigations, credentialing reviews, quality monitoring,\r\ncivil-rights reviews, or other oversight activities.\r\n<\/p>\r\n\r\n<p>\r\nThis may include the New Jersey Department of Human Services, the Division of\r\nDevelopmental Disabilities, Medicaid authorities, licensing agencies,\r\nand other authorized oversight bodies.\r\n<\/p>\r\n\r\n<h3>Judicial and administrative proceedings<\/h3>\r\n\r\n<p>\r\nWe may disclose PHI in response to a valid court order, administrative order,\r\nsubpoena, discovery request, or other lawful process when the applicable legal\r\nrequirements have been met.\r\n<\/p>\r\n\r\n<h3>Law enforcement<\/h3>\r\n\r\n<p>\r\nWe may disclose PHI to law-enforcement officials when permitted or required by\r\nlaw, including in response to certain legal processes, to report specific\r\ninjuries or crimes, to locate a person, or to address a serious threat.\r\n<\/p>\r\n\r\n<h3>Coroners, medical examiners, and funeral directors<\/h3>\r\n\r\n<p>\r\nWe may disclose PHI to a coroner, medical examiner, or funeral director when\r\nauthorized by law and necessary for that person to perform their duties.\r\n<\/p>\r\n\r\n<h3>Workers\u2019 compensation and similar programs<\/h3>\r\n\r\n<p>\r\nWe may disclose PHI as authorized by and necessary to comply with workers\u2019\r\ncompensation laws or similar programs established by law.\r\n<\/p>\r\n\r\n<h3>Research<\/h3>\r\n\r\n<p>\r\nWe may use or disclose PHI for research only when the research has received the\r\napprovals or waivers required by law, or when you have signed a valid\r\nauthorization.\r\n<\/p>\r\n\r\n<h3>Government functions and national security<\/h3>\r\n\r\n<p>\r\nWhen legally authorized, we may disclose PHI for certain specialized government\r\nfunctions, military or veterans\u2019 activities, national-security activities,\r\nprotective services, correctional-institution activities, or lawful custody\r\npurposes.\r\n<\/p>\r\n\r\n<div class=\"important\">\r\n<p class=\"important-title\">Required by law<\/p>\r\n<p>\r\nTHHS may use or disclose PHI when a federal or New Jersey law requires us to do\r\nso. We will disclose only the information required by that law.\r\n<\/p>\r\n<\/div>\r\n\r\n\r\n<!-- =========================================\r\n     SECTION 6\r\n========================================== -->\r\n\r\n<h2 id=\"npp-family\">6. Family members and others involved in your care<\/h2>\r\n\r\n<p>\r\nWhen appropriate and permitted by law, THHS may share information relevant to\r\nyour care or payment for your care with a family member, friend, guardian,\r\npersonal representative, Support Coordinator, or another person involved in\r\nhelping you.\r\n<\/p>\r\n\r\n<p>When you are present and able to make decisions, we may:<\/p>\r\n\r\n<ul>\r\n<li>Ask for your agreement.<\/li>\r\n<li>Give you an opportunity to object.<\/li>\r\n<li>Use professional judgment to determine that you do not object.<\/li>\r\n<\/ul>\r\n\r\n<p>\r\nIf you are not present, are incapacitated, or an emergency makes it impractical\r\nto ask you, we may use professional judgment to share information that is\r\ndirectly relevant to the person\u2019s involvement in your care and is in your best\r\ninterest.\r\n<\/p>\r\n\r\n<div class=\"example\">\r\n<p class=\"example-label\">Example<\/p>\r\n<p>\r\nIf a person you have identified helps coordinate transportation to a medical\r\nappointment, THHS may share the limited scheduling or support information\r\nreasonably needed for that purpose.\r\n<\/p>\r\n<\/div>\r\n\r\n<h3>Personal representatives and guardians<\/h3>\r\n\r\n<p>\r\nA person legally authorized to act on your behalf may exercise your privacy\r\nrights and receive information to the extent permitted by law and consistent\r\nwith that person\u2019s legal authority.\r\n<\/p>\r\n\r\n<p>\r\nTHHS may request documentation showing the representative\u2019s authority, such as\r\nguardianship papers, a healthcare power of attorney, or another legally\r\nrecognized document.\r\n<\/p>\r\n\r\n\r\n<!-- =========================================\r\n     SECTION 7\r\n========================================== -->\r\n\r\n<h2 id=\"npp-authorization\">7. When written authorization is required<\/h2>\r\n\r\n<p>\r\nTHHS will obtain your written authorization before using or disclosing your PHI\r\nwhen HIPAA or another applicable law requires authorization.\r\n<\/p>\r\n\r\n<div class=\"authorization-card\">\r\n\r\n<h3>A valid authorization generally identifies:<\/h3>\r\n\r\n<ul>\r\n<li>The information that may be used or disclosed.<\/li>\r\n<li>The person or organization permitted to disclose the information.<\/li>\r\n<li>The person or organization permitted to receive it.<\/li>\r\n<li>The purpose of the disclosure.<\/li>\r\n<li>An expiration date or expiration event.<\/li>\r\n<li>Your signature and the date signed.<\/li>\r\n<\/ul>\r\n\r\n<\/div>\r\n\r\n<p>Written authorization is generally required for:<\/p>\r\n\r\n<ul>\r\n<li>Most uses and disclosures of psychotherapy notes, when applicable.<\/li>\r\n<li>Most uses and disclosures for marketing, when applicable.<\/li>\r\n<li>Disclosures that constitute a sale of PHI, when applicable.<\/li>\r\n<li>Other uses and disclosures not otherwise permitted or required by law.<\/li>\r\n<\/ul>\r\n\r\n<h3>Revoking an authorization<\/h3>\r\n\r\n<p>\r\nYou may revoke an authorization at any time by giving THHS a written request.\r\nYour revocation will apply to future uses and disclosures. It will not undo\r\nactions already taken in reliance on the authorization.\r\n<\/p>\r\n\r\n<p>\r\nTHHS generally will not condition services, eligibility, or payment on your\r\nsigning an authorization, except when the law specifically permits such a\r\ncondition.\r\n<\/p>\r\n\r\n\r\n<!-- =========================================\r\n     SECTION 8\r\n========================================== -->\r\n\r\n<h2 id=\"npp-rights\">8. Your privacy rights<\/h2>\r\n\r\n<p>\r\nYou have important rights regarding your PHI. Some rights have legal limits or\r\nexceptions. THHS will explain any applicable requirements when you make a\r\nrequest.\r\n<\/p>\r\n\r\n<div class=\"rights-grid\">\r\n\r\n<article class=\"right-card\">\r\n<h3>Inspect and obtain a copy<\/h3>\r\n<p>\r\nYou may ask to inspect or receive an electronic or paper copy of PHI maintained\r\nin a designated record set. THHS will respond within the period required by law\r\nand may charge a reasonable, cost-based fee when permitted.\r\n<\/p>\r\n<\/article>\r\n\r\n<article class=\"right-card\">\r\n<h3>Request an amendment<\/h3>\r\n<p>\r\nYou may ask THHS to correct PHI that you believe is inaccurate or incomplete. We\r\nmay deny the request in certain circumstances, but we will explain the denial in\r\nwriting and describe your further rights.\r\n<\/p>\r\n<\/article>\r\n\r\n<article class=\"right-card\">\r\n<h3>Request confidential communications<\/h3>\r\n<p>\r\nYou may ask THHS to contact you in a particular way or at a different location.\r\nWe will accommodate reasonable requests as required by law.\r\n<\/p>\r\n<\/article>\r\n\r\n<article class=\"right-card\">\r\n<h3>Request restrictions<\/h3>\r\n<p>\r\nYou may ask us not to use or disclose certain PHI for treatment, payment,\r\nhealthcare operations, or to people involved in your care. We are not always\r\nrequired to agree, except in circumstances where the law requires agreement.\r\n<\/p>\r\n<\/article>\r\n\r\n<article class=\"right-card\">\r\n<h3>Receive an accounting of disclosures<\/h3>\r\n<p>\r\nYou may request a list of certain disclosures of your PHI made during the period\r\nallowed by law. The accounting will not include every disclosure, such as many\r\ndisclosures for treatment, payment, or healthcare operations.\r\n<\/p>\r\n<\/article>\r\n\r\n<article class=\"right-card\">\r\n<h3>Receive a paper copy<\/h3>\r\n<p>\r\nYou may request a paper copy of this Notice at any time, even if you previously\r\nagreed to receive it electronically.\r\n<\/p>\r\n<\/article>\r\n\r\n<article class=\"right-card\">\r\n<h3>Choose someone to act for you<\/h3>\r\n<p>\r\nA legally authorized personal representative may exercise your rights on your\r\nbehalf. THHS may verify that person\u2019s authority before acting on a request.\r\n<\/p>\r\n<\/article>\r\n\r\n<article class=\"right-card\">\r\n<h3>File a complaint<\/h3>\r\n<p>\r\nYou may complain to THHS or to the U.S. Department of Health and Human Services\r\nif you believe your privacy rights were violated. THHS will not retaliate\r\nagainst you.\r\n<\/p>\r\n<\/article>\r\n\r\n<\/div>\r\n\r\n<h3>How to submit a request<\/h3>\r\n\r\n<p>\r\nContact the THHS Privacy Officer using the information in Section 12. We may ask\r\nyou to submit the request in writing and to provide information needed to verify\r\nyour identity and understand the request.\r\n<\/p>\r\n\r\n<div class=\"important\">\r\n<p class=\"important-title\">Restriction for services paid fully out of pocket<\/p>\r\n<p>\r\nWhen applicable, if you pay THHS in full out of pocket for a healthcare item or\r\nservice and ask us not to disclose information about that item or service to a\r\nhealth plan for payment or healthcare operations, we will honor the request when\r\nthe law requires us to do so.\r\n<\/p>\r\n<\/div>\r\n\r\n\r\n<!-- =========================================\r\n     SECTION 9\r\n========================================== -->\r\n\r\n<h2 id=\"npp-special-records\">9. Specially protected information<\/h2>\r\n\r\n<p>\r\nSome types of information may receive additional protection under federal or New\r\nJersey law. When a more protective law applies, THHS will follow that law.\r\n<\/p>\r\n\r\n<h3>HIV-related information<\/h3>\r\n\r\n<p>\r\nInformation concerning a person\u2019s HIV status is handled according to applicable\r\nconfidentiality requirements and the safeguards reflected in New Jersey Division\r\nCircular #45.\r\n<\/p>\r\n\r\n<p>\r\nTHHS\u2019s approved operational policy provides that HIV-status information is not\r\nincluded in the general individual record and is made available only in\r\naccordance with the applicable circular and law.\r\n<\/p>\r\n\r\n<h3>Substance use disorder records<\/h3>\r\n\r\n<p>\r\nRecords created or maintained by a federally assisted substance use disorder\r\nprogram may be protected by 42 CFR Part 2 in addition to HIPAA. When THHS\r\nreceives or maintains Part 2 records, we will use and disclose them only as\r\npermitted by applicable law.\r\n<\/p>\r\n\r\n<h3>Psychotherapy notes and other sensitive records<\/h3>\r\n\r\n<p>\r\nPsychotherapy notes, genetic information, certain communicable-disease\r\ninformation, and other specially protected records may be subject to additional\r\nrestrictions. THHS will obtain authorization or follow another legally permitted\r\nprocess when required.\r\n<\/p>\r\n\r\n<div class=\"important\">\r\n<p class=\"important-title\">More protective laws control<\/p>\r\n<p>\r\nWhen New Jersey or another applicable law gives your information greater\r\nprotection than HIPAA, THHS will follow the more protective requirement.\r\n<\/p>\r\n<\/div>\r\n\r\n\r\n<!-- =========================================\r\n     SECTION 10\r\n========================================== -->\r\n\r\n<h2 id=\"npp-breach\">10.
