Where the two differ, the regulation controls.\r\n<\/div>\r\n\r\n<ol class=\"rights\">\r\n\r\n<li class=\"right\">\r\n<p class=\"right-num\"><\/p>\r\n<p class=\"right-text\">\r\nTo treatment and services without discrimination based on race, age, religion,\r\nnational origin, sex, sexual preference, handicap, diagnosis, ability to pay, or\r\nsource of payment.\r\n<\/p>\r\n<p class=\"right-plain\">\r\nWe care for you the same regardless of who you are, what you have, what you\r\nbelieve, or how your care is paid for.\r\n<\/p>\r\n<\/li>\r\n\r\n<li class=\"right\">\r\n<p class=\"right-num\"><\/p>\r\n<p class=\"right-text\">\r\nTo be given a written notice, prior to the initiation of care, of these patient\r\nrights and any additional policies and procedures established by the agency\r\ninvolving patient rights and responsibilities. If a patient is unable to respond,\r\nthe agency shall give the notice to a family member or other responsible\r\nindividual.\r\n<\/p>\r\n<p class=\"right-plain\">\r\nYou get this document in writing <em>before<\/em> care starts \u2014 not after. If you\r\ncannot take it in yourself, we give it to your family member or representative.\r\n<\/p>\r\n<\/li>\r\n\r\n<li class=\"right\">\r\n<p class=\"right-num\"><\/p>\r\n<p class=\"right-text\">\r\nTo be informed in writing of the following:\r\n<ul>\r\n<li>Services available from the agency;<\/li>\r\n<li>The names and professional status of personnel providing and\/or responsible for care;<\/li>\r\n<li>The frequency of home visits to be provided; and<\/li>\r\n<li>The agency\u2019s daytime and emergency telephone numbers.<\/li>\r\n<\/ul>\r\n<\/p>\r\n<p class=\"right-plain\">\r\nIn writing: what we offer, who is coming to your home and what their qualifications\r\nare, how often they will come, and how to reach us \u2014 including after hours.\r\n<\/p>\r\n<\/li>\r\n\r\n<li class=\"right\">\r\n<p class=\"right-num\"><\/p>\r\n<p class=\"right-text\">\r\nTo receive, in terms that the patient understands, an explanation of his or her\r\nplan of care, expected results, and reasonable alternatives. If receiving this\r\ninformation would be detrimental to the patient\u2019s health, or if the patient is not\r\nable to understand the information, the agency shall provide the explanation to a\r\nfamily member or guardian and document the provision of the explanation in the\r\npatient\u2019s medical record.\r\n<\/p>\r\n<p class=\"right-plain\">\r\nYour plan of care explained in words you actually understand \u2014 what we expect to\r\nhappen, and what your other options are. If we have explained it and you do not\r\nunderstand it, we have not explained it.\r\n<\/p>\r\n<\/li>\r\n\r\n<li class=\"right\">\r\n<p class=\"right-num\"><\/p>\r\n<p class=\"right-text\">\r\nTo receive, as soon as possible, the services of a translator or interpreter to\r\nfacilitate communication between the patient and health care personnel.\r\n<\/p>\r\n<p class=\"right-plain\">\r\nAn interpreter, as soon as we can get one. At no cost to you. You never have to\r\nrely on a relative to translate your own medical care.\r\n<\/p>\r\n<\/li>\r\n\r\n<li class=\"right\">\r\n<p class=\"right-num\"><\/p>\r\n<p class=\"right-text\">\r\nTo receive ordered care and health services.\r\n<\/p>\r\n<p class=\"right-plain\">\r\nThe care your doctor ordered is the care you get.\r\n<\/p>\r\n<\/li>\r\n\r\n<li class=\"right\">\r\n<p class=\"right-num\"><\/p>\r\n<p class=\"right-text\">\r\nTo participate in the planning of the patient\u2019s home health care and treatment.\r\n<\/p>\r\n<p class=\"right-plain\">\r\nYou are in the room where your care is planned. Not consulted afterward \u2014 present\r\nfor it.\r\n<\/p>\r\n<\/li>\r\n\r\n<li class=\"right\">\r\n<p class=\"right-num\"><\/p>\r\n<p class=\"right-text\">\r\nTo refuse services, including medication and treatment, that an agency provides\r\nand to be informed of available home health treatment options, including the option\r\nof no treatment and of the possible benefits and risks of each option.\r\n<\/p>\r\n<p class=\"right-plain\">\r\nYou can say no. To a medication, to a treatment, to all of it. We will tell you\r\nhonestly what each choice means \u2014 including the choice to do nothing \u2014 and then\r\nwe will respect the one you make.\r\n<\/p>\r\n<\/li>\r\n\r\n<li class=\"right\">\r\n<p class=\"right-num\"><\/p>\r\n<p class=\"right-text\">\r\nTo refuse to participate in experimental research. If a patient chooses to\r\nparticipate in experimental research, an agency shall obtain the patient\u2019s written\r\ninformed consent.\r\n<\/p>\r\n<p class=\"right-plain\">\r\nYou are never enrolled in research without knowing, and never without signing.\r\n<\/p>\r\n<\/li>\r\n\r\n<li class=\"right\">\r\n<p class=\"right-num\"><\/p>\r\n<p class=\"right-text\">\r\nTo receive full information about financial arrangements, including, but not\r\nlimited to:\r\n<ul>\r\n<li>Fees and charges, including any fees and charges for services not covered by sources of third-party payment;<\/li>\r\n<li>Copies of written records of financial arrangements;<\/li>\r\n<li>Notification of any additional charges, expenses, or other financial liabilities in excess of the predetermined fee; and<\/li>\r\n<li>Description of agreements with third-party payers and\/or other payers and referral systems for patients\u2019 financial assistance.<\/li>\r\n<\/ul>\r\n<\/p>\r\n<p class=\"right-plain\">\r\nNo surprise bills. You are told what things cost, what your insurance covers, what\r\nit does not, and what you may owe \u2014 before you owe it.\r\n<\/p>\r\n<\/li>\r\n\r\n<li class=\"right\">\r\n<p class=\"right-num\"><\/p>\r\n<p class=\"right-text\">\r\nTo express grievances to an agency\u2019s staff and governing authority regarding care\r\nand services without fear of reprisal, and to receive an answer to those grievances\r\nwithin a reasonable time.\r\n<\/p>\r\n<p class=\"right-plain\">\r\nYou can complain, to anyone here, all the way up. Nothing bad happens to you for\r\nit. And you get an actual answer.\r\n<\/p>\r\n<\/li>\r\n\r\n<li class=\"right\">\r\n<p class=\"right-num\"><\/p>\r\n<p class=\"right-text\">\r\nTo be free from mental and physical abuse and from exploitation.\r\n<\/p>\r\n<p class=\"right-plain\">\r\nNo one may hurt you, frighten you, or take advantage of you. Not our staff. Not\r\nanyone.\r\n<\/p>\r\n<\/li>\r\n\r\n<li class=\"right\">\r\n<p class=\"right-num\"><\/p>\r\n<p class=\"right-text\">\r\nTo be free from restraints, unless they are authorized by a physician for a limited\r\nperiod of time to protect the patient or others from injury.\r\n<\/p>\r\n<p class=\"right-plain\">\r\nYou will not be restrained \u2014 unless a doctor orders it, for a limited time, to\r\nstop someone from being hurt.\r\n<\/p>\r\n<\/li>\r\n\r\n<li class=\"right\">\r\n<p class=\"right-num\"><\/p>\r\n<p class=\"right-text\">\r\nTo be assured of confidential treatment of the patient\u2019s medical\/health record, and\r\nto approve or refuse in writing its release to any individual outside the agency,\r\nexcept as required by law or third-party payment contract.\r\n<\/p>\r\n<p class=\"right-plain\">\r\nYour record is private. You decide, in writing, who outside THHS sees it \u2014 except\r\nwhere the law requires otherwise. Our\r\n<a href=\"\/privacy-notice\">Notice of Privacy Practices<\/a> explains this in full.\r\n<\/p>\r\n<\/li>\r\n\r\n<li class=\"right\">\r\n<p class=\"right-num\"><\/p>\r\n<p class=\"right-text\">\r\nTo be treated with courtesy, consideration, respect, and recognition of the\r\npatient\u2019s dignity, individuality, and right to privacy, including, but not limited\r\nto, auditory and visual privacy and confidentiality concerning patient treatment\r\nand disclosures.\r\n<\/p>\r\n<p class=\"right-plain\">\r\nYou are treated like a person, in your own home, with the door closed and the\r\ncurtain drawn.\r\n<\/p>\r\n<\/li>\r\n\r\n<li class=\"right\">\r\n<p class=\"right-num\"><\/p>\r\n<p class=\"right-text\">\r\nTo be assured of respect for the patient\u2019s personal property.\r\n<\/p>\r\n<p class=\"right-plain\">\r\nYour things are your things. We do not move them, use them, or take them.\r\n<\/p>\r\n<\/li>\r\n\r\n<li class=\"right\">\r\n<p class=\"right-num\"><\/p>\r\n<p class=\"right-text\">\r\nTo join with other patients or individuals to work for improvements in patient care.\r\n<\/p>\r\n<p class=\"right-plain\">\r\nYou may organize. You may advocate. You may work with others to change how care is\r\ndone \u2014 including ours.\r\n<\/p>\r\n<\/li>\r\n\r\n<li class=\"right\">\r\n<p class=\"right-num\"><\/p>\r\n<p class=\"right-text\">\r\nTo retain and exercise to the fullest extent possible, all the constitutional,\r\ncivil, and legal rights to which the patient is entitled by law, including religious\r\nliberties, the right to independent personal decisions, and the right to provide\r\ninstructions and directions for health care in the event of future decision making\r\nincapacity in accordance with the New Jersey Advance Directives for Health Care\r\nAct, N.J.S.A. 26:2H-53 et seq., the Physician Orders for Life-Sustaining Treatment\r\nAct, N.J.S.A. 26:2H-129 et seq., and with N.J.A.C. 8:42-6.5.\r\n<\/p>\r\n<p class=\"right-plain\">\r\nNeeding care does not cost you a single one of your rights as a citizen. You may\r\nworship, decide, and record in advance what you want done if you can no longer\r\nspeak for yourself.\r\n<\/p>\r\n<\/li>\r\n\r\n<li class=\"right\">\r\n<p class=\"right-num\"><\/p>\r\n<p class=\"right-text\">\r\nTo be transferred to another agency only for one of the reasons delineated at\r\nN.J.A.C. 8:42-6.6.\r\n<\/p>\r\n<p class=\"right-plain\">\r\nWe cannot hand you off to another agency for just any reason. The law lists the\r\nreasons, and we must have one.\r\n<\/p>\r\n<\/li>\r\n\r\n<li class=\"right\">\r\n<p class=\"right-num\"><\/p>\r\n<p class=\"right-text\">\r\nTo discharge himself or herself from treatment by the agency.\r\n<\/p>\r\n<p class=\"right-plain\">\r\nYou can stop. At any time. You do not need our permission and you do not need to\r\njustify it.\r\n<\/p>\r\n<\/li>\r\n\r\n<li class=\"right\">\r\n<p class=\"right-num\"><\/p>\r\n<p class=\"right-text\">\r\nTo file a complaint with the New Jersey Department of Health.\r\n<\/p>\r\n<p class=\"right-plain\">\r\nYou can go over our heads, straight to the State. It is a privilege you are being\r\nallowed to keep.\u201d\r\n<\/p>\r\n<\/div>\r\n\r\n\r\n<!-- =========================================================\r\n     FEDERAL\r\n========================================================= -->\r\n\r\n<h2 id=\"bor-federal\">Additional rights under Medicare<\/h2>\r\n\r\n<div class=\"citation\">\r\n<strong>Source of law<\/strong>\r\nTHHS is a Medicare-certified home health agency. The rights below come from\r\n<strong>42 CFR 484.50<\/strong>, the federal Condition of Participation on patient\r\nrights. They sit on top of the New Jersey rights above \u2014 they do not replace them.\r\n<\/div>\r\n\r\n<h3>Before care begins, we must give you<\/h3>\r\n\r\n<ul>\r\n<li>Written notice of your rights and responsibilities, and of our transfer and discharge policies \u2014 in a language and manner you understand, accessible if you have a disability.<\/li>\r\n<li>The name, business address, and business phone number of the THHS administrator, so you can complain directly to the top.<\/li>\r\n<li>An <strong>OASIS privacy notice<\/strong>, if we collect OASIS data about you.<\/li>\r\n<li>A request for your signature confirming you received all of this. You are entitled to a copy.<\/li>\r\n<\/ul>\r\n\r\n<p>\r\nIf you name a representative, we must give them the same written notice within\r\n<strong>four business days<\/strong> of the initial evaluation visit.\r\n<\/p>\r\n\r\n<h3>You also have the federal right to<\/h3>\r\n\r\n<ul>\r\n<li>Have your <strong>property and person treated with respect<\/strong>.<\/li>\r\n<li>Be free from <strong>verbal, mental, sexual, and physical abuse<\/strong>, including injuries of unknown source, neglect, and misappropriation of your property.<\/li>\r\n<li>Participate in, be informed about, and <strong>consent to or refuse<\/strong> care \u2014 including your assessments, your plan of care, which disciplines will provide it, how often, the expected outcomes and the risks, and any change to any of it.<\/li>\r\n<li>Receive <strong>all services<\/strong> in your plan of care.<\/li>\r\n<li>Be told, orally and in writing, what Medicare or Medicaid will pay, what they will not, and what you may have to pay <em>before<\/em> care starts.<\/li>\r\n<li>Receive <strong>written notice in advance<\/strong> if we believe a service may not be covered, or before we reduce or end your care.<\/li>\r\n<li>Be told about the <strong>state toll-free home health hotline<\/strong> \u2014 its number, its hours, and that it exists to take complaints about agencies like us.<\/li>\r\n<li>Be given the names, addresses, and phone numbers of the <strong>Agency on Aging, Center for Independent Living, Protection and Advocacy Agency, Aging and Disability Resource Center, and Quality Improvement Organization<\/strong> serving your area.<\/li>\r\n<li>Be <strong>free from discrimination or reprisal<\/strong> for using your rights or voicing a grievance \u2014 to us, or to anyone outside.<\/li>\r\n<li>Be told about, and given, <strong>auxiliary aids and language services at no cost to you<\/strong>.<\/li>\r\n<\/ul>\r\n\r\n<div class=\"important\">\r\n<p class=\"important-title\">REVIEW \u00b7 This section is incomplete<\/p>\r\n<p>\r\n42 CFR 484.50(c)(10) requires us to publish the actual names, addresses, and\r\ntelephone numbers of the five referral agencies serving each county we operate in.\r\nThose must be filled in before this page is published. A generic reference does not\r\nsatisfy the requirement.\r\n<\/p>\r\n<\/div>\r\n\r\n<h3>Transfer and discharge<\/h3>\r\n\r\n<p>\r\nWe may only transfer or discharge you for a reason the regulation permits: your\r\nneeds exceed what we can safely meet; you or your payer will no longer pay; your\r\ngoals have been met and your physician agrees you no longer need us; you refuse\r\nservices or choose to leave; a discharge for cause under a written policy; you die;\r\nor THHS ceases to operate.\r\n<\/p>\r\n\r\n<p>\r\nBefore any discharge for cause, we must tell you and your physician it is being\r\nconsidered, make real efforts to resolve the problem, give you contact information\r\nfor other providers who may be able to help, and document all of it.\r\n<\/p>\r\n\r\n\r\n<!-- =========================================================\r\n     PART TWO\r\n========================================================= -->\r\n\r\n<h2 id=\"bor-ddd\">Part Two \u2014 If you receive developmental disability services<\/h2>\r\n\r\n<div class=\"important\">\r\n<p class=\"important-title\">REVIEW \u00b7 Verify against the governing Division Circular<\/p>\r\n<p>\r\nThe rights below reflect the principles the New Jersey Division of Developmental\r\nDisabilities operates under \u2014 individual choice, community participation, and\r\ndignity. <strong>They are not yet tied to a specific Division Circular citation.<\/strong>\r\nBefore publication, THHS must confirm which circular governs participant rights and\r\ncite it here, in the same way Part One cites N.J.A.C. 8:42-13.2.\r\n<\/p>\r\n<\/div>\r\n\r\n<h3>Your life is yours to direct<\/h3>\r\n\r\n<ul>\r\n<li>You choose. Where you live, who supports you, how your day is shaped, what you do with it, and what you say no to.<\/li>\r\n<li>You may make choices that the people around you \u2014 family, friends, staff \u2014 would not have made for you. That is what a choice is.<\/li>\r\n<li>You participate in writing your own Individualized Service Plan. It is written with you, not about you.<\/li>\r\n<li>You may change your mind, change your goals, and change your provider.<\/li>\r\n<\/ul>\r\n\r\n<h3>Your place in the community<\/h3>\r\n\r\n<ul>\r\n<li>You have the right to live, work, and take part in your community alongside people who do not have disabilities.<\/li>\r\n<li>You have the right to relationships of your own choosing \u2014 friendships, and intimate relationships.<\/li>\r\n<li>You have the right to privacy in your own home and in your own person.<\/li>\r\n<li>You have the right to your own money and your own property.<\/li>\r\n<\/ul>\r\n\r\n<h3>Your safety and dignity<\/h3>\r\n\r\n<ul>\r\n<li>You have the right to be free from abuse, neglect, and exploitation, and to have any such incident reported and investigated.<\/li>\r\n<li>You have the right to be free from restraint and from any aversive practice.<\/li>\r\n<li>You have the right to be spoken to as an adult, in words you understand, in whatever way you communicate.<\/li>\r\n<li>You have the right to complain \u2014 to THHS, to your Support Coordinator, and to the Division \u2014 without any consequence to your services.<\/li>\r\n<\/ul>\r\n\r\n<h3>Your rights are not conditional<\/h3>\r\n\r\n<ul>\r\n<li>Having a guardian does not remove your rights. It changes who exercises some of them, on your behalf, within the limits a court has set.<\/li>\r\n<li>Needing support does not make you a child, and it does not make your preferences suggestions.<\/li>\r\n<\/ul>\r\n\r\n<div class=\"dignity-note\">\r\n<p>\r\n\u201cThe dignity of risk is a right too. A life with no possibility of failure in it is\r\nnot a safe life. It is a small one.\u201d\r\n<\/p>\r\n<\/div>\r\n\r\n\r\n<!-- =========================================================\r\n     RESPONSIBILITIES\r\n========================================================= -->\r\n\r\n<h2 id=\"bor-responsibilities\">What we ask of you<\/h2>\r\n\r\n<p>\r\nNew Jersey requires us to inform you of responsibilities as well as rights. These\r\nare requests, not conditions. <strong>Failing to meet them does not cost you a\r\nsingle right listed above.<\/strong>\r\n<\/p>\r\n\r\n<ul>\r\n<li>Tell us honestly about your health, your medications, and your history \u2014 it is how we keep you safe.<\/li>\r\n<li>Tell us when something changes: your condition, your address, your insurance, your representative.<\/li>\r\n<li>Tell us if you do not understand something, or if you do not intend to follow the plan. We would rather know than guess.<\/li>\r\n<li>Treat our staff with the same respect we owe you.<\/li>\r\n<li>Let us know if you will not be home for a scheduled visit.<\/li>\r\n<\/ul>\r\n\r\n\r\n<!-- =========================================================\r\n     COMPLAINTS\r\n========================================================= -->\r\n\r\n<h2 id=\"bor-complaints\">If a right is not honored<\/h2>\r\n\r\n<p>\r\nTell us. You may do it by phone, by email, by letter, or by telling any THHS staff\r\nmember in your home. You do not need to put it in writing, and you do not need to\r\nuse a particular form or word.\r\n<\/p>\r\n\r\n<p>\r\nWe will investigate, we will document it, and we will tell you what we found and\r\nwhat we are doing. We will act to prevent it happening again \u2014 including protecting\r\nyou from any retaliation while we look into it.\r\n<\/p>\r\n\r\n<div class=\"complaint-grid\">\r\n\r\n<article class=\"complaint-card\">\r\n<h3>Complain to THHS<\/h3>\r\n<p>\r\nStart with anyone here \u2014 your aide, your nurse, the office, or the Administrator\r\ndirectly. Going to your aide first is not a lesser complaint. It counts.\r\n<\/p>\r\n<\/article>\r\n\r\n<article class=\"complaint-card\">\r\n<h3>Complain to the State<\/h3>\r\n<p>\r\nYou may call the NJ Department of Health hotline at <strong>1 (800) 792-9770<\/strong>,\r\nany hour, without telling us. For DDD services, you may also contact your Support\r\nCoordinator or the Division directly.\r\n<\/p>\r\n<\/article>\r\n\r\n<article class=\"complaint-card\">\r\n<h3>Complain about privacy<\/h3>\r\n<p>\r\nFor anything involving your health information, contact the THHS Privacy Officer,\r\nor file with the U.S. Department of Health and Human Services, Office for Civil\r\nRights.\r\n<\/p>\r\n<\/article>\r\n\r\n<article class=\"complaint-card\">\r\n<h3>Complain about access<\/h3>\r\n<p>\r\nIf a barrier at THHS left you out, see our\r\n<a href=\"\/accessibility\">Accessibility Statement<\/a>. We treat that as our problem\r\nto solve, not yours.\r\n<\/p>\r\n<\/article>\r\n\r\n<\/div>\r\n\r\n<div class=\"important\">\r\n<p class=\"important-title\">We will never retaliate<\/p>\r\n<p>\r\nFiling a complaint \u2014 with us, with the State, or with anyone else \u2014 will never\r\naffect your services, your eligibility, or how you are treated the next morning.\r\nThis is not a courtesy.
